Resolution No. 11 -12, Summary Publication of Ordinance No. 03 -11. 137 138 Council Member Rafferty moved to approve Resolution No. 11 -12 as presented. Council Member 139 Roeser seconded the motion. Motion carried on a unanimous voice vote. 140 6C) Second Reading and Passage of Ordinance Number 04 -11, Amending the zoning 141 ordinance requirements regarding Home Occupations — City Planner Smyser explained that the 142 proposed ordinance would amend the city's home occupation regulations. The city council recently 143 discussed those regulations and requested that staff review them as they apply to sale of goods not 144 made on site. 145 146 Council Member O'Donnell moved to dispense with full reading of the ordinance. Council Member 147 Roeser seconded the motion. Motion carried on a unanimous voice vote. 148 149 Council Member Rafferty moved to approve second reading and passage of Ordinance No. 04 -11 as 150 presented. Council Member Gallup seconded the motion. Motion carried: Yeas; 5; Nays none. 151 152 6D) Second Reading and Passage of Ordinance No. 05 -11 Amending Section 507 of City Code 153 Regarding Solid Waste Collection Times — Environmental Coordinator Asleson reported that the 154 City has received complaints about early solid waste pick up activities in residential areas and is 155 presenting an ordinance that would change the city's regulations to allow no solid waste activity in 156 residential areas before 7:00 a.m. (previously 6:00 a.m.). The commercial /industrial areas could be 157 serviced as early as 6:00 a.m. A council member confirmed that the solid waste haulers have been • 158 consulted on this change and do not have major concerns. 159 160 Council Member Rafferty moved to dispense with full reading of the ordinance. Council Member 161 Roeser seconded the motion. Motion carried on a unanimous voice vote. 162 163 Council Member Rafferty moved to approve second reading and passage of Ordinance No. 05 -11 as 164 presented. Council Member Gallup seconded the motion. Motion carried: Yeas; 5; Nays none. 165 166 6E) Resolution No. 11 -01, Approving final payment and change order for 2010 Overlay Project 167 - City Engineer Studenski explained that the 2010 Overlay project has been completed by the 168 contractor, Rum River Contracting Company. There is a change order being requested; with that 169 change, the project would come in very close their bid and under the original estimate. The project is 170 done to staff's satisfaction and he is recommending that the council approve the change order and 171 final payment on the project. 172 173 Council Member O'Donnell moved to approve Resolution No. 11 -01 as presented. Council Member 174 Roeser seconded the motion. Motion carried on a unanimous voice vote. 175 176 6F) 2011 Street Maintenance Project: i) Resolution No. 11 -02, Authorize preparations of plans 177 and specifications for the 2011 Sealcoat Project — City Engineer Studenski reviewed the basis for 178 the sealcoating project (the city's Pavement Management Plan) and then explained how streets are 179 chosen for the process. • 4
