151-1,(1906 k_.c,.s, /z&7/1( <br />Answers to Steve Guzzetta's questions regarding Connect Anoka County, <br />sent via email to Tom Haluska, Assistant Anoka County Attorney, on March <br />14, 2011. <br />1. Please describe how individual connectivity services agreements relate to <br />Anoka County's August 17, 2010, Wholesale Master Service Agreement with <br />ZAYO Broadband, LLC ("ZAYO'). For example, will local government parties to <br />a connectivity services agreement be subject the acceptable use policy set forth <br />in the Master Service Agreement. <br />Anoka County is required by the MSA to secure the agreement of the various <br />entities who own non - County co- location sites. The connectivity service <br />agreements are pass through, so where the County is subject to provisions in the <br />MSA for connectivity, those requirements are applicable to the Entities in the <br />Connectivity Services Agreements. Those provisions have been incorporated <br />directly into the language of the CSA. <br />Regarding the example, the Acceptable Use Policy (section 18.3 of the MSA): 1) <br />prohibits Anoka County from using the network for illegal purposes; 2) allows <br />Zayo to remove materials such as child pornography and other objectionable <br />materials from the network; and 3) provides that Zayo may co- operate with <br />investigations into criminal activity. While sec. 18 provides additional terms and <br />conditions applicable only to the purchase of IP /Data based services which would <br />not be passed through to the entities, the CSA does require compliance with laws <br />relating to the provision of services (Section XI). Trafficking in Internet Child <br />Pornography is illegal, as is using the Internet for identity theft, and would be a <br />breach of Section XI. It seemed superfluous to repeat the AUP provision in the <br />CSA. <br />2. A. Please provide a detailed description of the "ZAYO System" that will be <br />utilized to provide Connectivity Services to local government units pursuant to a <br />connectivity services agreement, including the number of fibers, the types of <br />fibers to be used, the types of optronics to be used, the network design and <br />topology to be used, back -up and standby power capabilities, and the <br />bandwidth /capacity limits of each portion or segment of the ZAYO System. <br />B. What happens if certain entities do not participate in the project (so that <br />specific anticipated co- location sites are not available)? <br />C. How will that alter the ZAYO System design? <br />A. See the IRU and MSA . <br />
