• <br />• <br />• <br />AGENDA ITEM NO. 1B <br />STAFF ORIGINATOR: Rick DeGardner, Public Services Director <br />COUNCIL MEETING DATE: January 14, 2002 <br />TOPIC: Consideration of Easement Agreement from the City <br />to the Schut's <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />On July 9th, 2001, the City Council approved the Stipulation of Settlement Proposal with <br />Mr. Ronald Schut and Mrs. Lisa Schut Callies pertaining to the Black Duck Trail. Item <br />#7 indicates that, "... the Petitioner hereby grants to the Respondent a non - exclusive <br />and perpetual easement over, upon, across and through the property described in <br />Exhibit A. This perpetual easement is for pedestrian and vehicular access." <br />Mr. Hawkins has drafted the proposed Easement Agreement. This agenda item <br />authorizes the Mayor and City Clerk to execute the Easement Agreement as required <br />by the approved Stipulation of Settlement. <br />OPTIONS <br />1. Authorize the Mayor and City Clerk to execute the Easement Agreement. <br />2. Return to staff for further review. <br />RECOMMENDATION: <br />Option 1 <br />1/9/02 <br />RD/Trails /Blackduck/greensheet schut easement <br />
