• <br />• <br />EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT is made and entered into as of the day <br />of , 20 , by and between the City of Lino Lakes, a <br />Minnesota municipal corporation (the "City "), and Ronald L. Schut and Lisa Schut <br />Callies, husband and wife, (collectively the "Schuts "). <br />WHEREAS, the City is the owner of certain real property in Anoka County, <br />Minnesota, legally described in Exhibit A attached hereto (the "City Property "); <br />WHEREAS„ the Schuts are the owners of certain real property in Anoka <br />County, Minnesota, legally described in Exhibit B attached hereto (the "Schuts <br />Property "); and <br />WHEREAS, the Schuts are requesting, and the City is willing to grant, an <br />easement over the City Property for the purposes and upon the terms and <br />conditions described herein; <br />NOW, THEREFORE, in consideration of the foregoing promises and for other <br />good and valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, the parties hereby agree as follows: <br />1. Grant of Easement. The City hereby grants to the Schuts a non- <br />exclusive easement, for the purposes described in paragraph 3 below, over, upon, <br />across and through the City Property (the "Easement "). <br />2. Duration. The Easement shall be perpetual and appurtenant to the <br />Schuts Property and shall be binding upon and inure to the benefit of the <br />successors and assigns of the City and the Schuts. <br />3. Purpose and Use of Easement. Those persons who may, from time to <br />time, be members of the immediate family of the Schuts and /or its invitees or <br />guests of the Schuts (collectively "Permitted Users ") shall have the perpetual right <br />to use the Easement for pedestrian and vehicular access to and from the Schuts <br />Property. <br />4. Further Acts and Assurances. Each party agrees that, at any time and <br />from time to time, on and after the date hereof, upon the reasonable request of the <br />other party, they will do or cause to be done all such further acts and things and <br />execute, acknowledge and deliver, or cause to be executed, acknowledged and <br />delivered any and all papers, documents, instruments, agreements, deeds, <br />• assignments, transfers, assurances and conveyances as may be necessary or <br />1 <br />
