MEETING DATE: February 11, 2002 <br />TOPIC: Consideration of Resolution 02 -06 <br />amending a Conditional Use Permit for the <br />construction of a picnic shelter <br />ACTION REQUIRED: <br />BACKGROUND <br />Gethsemane United Methodist Church <br />7330 Lake Drive <br />3/5 vote <br />The subject property is zoned R -3, Medium Density Residential. Churches are a <br />conditional use within the R -3 district. <br />The Church is requesting a Conditional Use Permit amendment to construct a picnic <br />shelter on the property. The Section 2, Subdivision 2.B13 of the City Zoning Ordinance <br />states that, "any enlargement, structural alteration, or intensification of such use shall <br />require an amended conditional use permit." <br />ANALYSIS <br />The proposed picnic shelter is classified as an accessory building (see Exhibit #2). It is <br />anticipated the picnic shelter would be used for the Church's annual Booya Festival, <br />Vacation bible School classes, Youth Events, Church picnics, and reunions. <br />Under City Zoning Ordinance Section 3, Subd. 4.D.8.f., accessory buildings for property <br />located within an R -3 zone, greater than one and one - quarter acres in size, are limited in <br />number to a maximum of one attached garage and two detached accessory structures. <br />The maximum total square footage for accessory buildings in an R -3 zone for a lot of this <br />size is limited to 2,020 sq. ft. <br />There are currently two detached accessory buildings on the property: an 8' X 10' tool <br />shed and a 24' X 30' detached garage. The construction of the proposed picnic shelter <br />would result in three detached accessory structures, one more than is allowed under City <br />Ordinance. <br />The total square footage of the existing two accessory buildings is 800 sq. ft. The <br />proposed picnic shelter would measure 1,380 sq. ft. (30' X 46'), resulting in a total <br />
