• • CITY COUNCIL WORK SESSION APRIL 3, 2002 CITY OF LINO LAKES MINUTES DATE : April 3, 2002 TIME STARTED : 5:30 p.m. TIME ENDED : 8:30 p.m. MEMBERS PRESENT : Council Member Dahl, Carlson, O'Donnell, and Reinert MEMBERS ABSENT : Mayor Bergeson Staff members present: Administration Director, Dan Tesch; Economic Development Assistant, Mary Alice Divine (part); Chief of Police, Dave Pecchia (part); Community Development Director, Michael Grochala; City Engineer, Jim Studenski; Finance Director, Al Rolek; and City Clerk, Ann Blair THORP PROPERTY — MINOR SUBDIVISION REQUEST — JEFF JOYER City Clerk Blair distributed an information packet from City Planner Smyser regarding this issue. The information advised the City received an application for a building permit for a new house. The lot in question has a large garage on it but no house. The size of the existing garage exceeds the maximum square footage for accessory buildings. Obviously, a variance would be needed for the addition of the proposed attached garage. The Associate Planner began researching the variance application. She discovered that the lot in question was not a legal parcel by itself. It is part of a larger tax parcel. The two lots platted in 1948 were subsequently combined. To split them apart requires a minor subdivision. The minimum lot size in the area is ten acres. The existing property is smaller than that and reducing it further increases the nonconformity. Mr. Jeff Joyer, realtor for Mr. and Mrs. Thorp, reviewed the background of the lot history and distributed a map showing the property in question. Community Development Director Grochala noted the City has no provision for an administrative subdivision. The subdivision has to go through the application and review process, and ultimately must be approved by the Council. Because the property is less than ten acres, staff would recommend denial of the subdivision request. Acting Mayor Reinert questioned whether the County, without the permission of the property owners, combined the property. City Clerk Blair stated she has discussed this issue with the County. The County assured the City that lots do not get combined without a request from the property owners.
