CITY COUNCIL WORK SESSION <br />APRIL 3, 2002 <br />Councilmember O'Donnell inquired about the variance request for the garage. <br />Mr. Joyer stated the garage was built in 1975. The setback for the garage was met at that <br />time. He stated that Mr. and Mrs. Thorp did not ask the County to combine the lots. He <br />further stated they were unaware that the lots were combined. <br />Community Development Director Grochala stated the new garage with the existing <br />garage would exceed the accessory structure requirements. <br />Mr. Joyer stated Mr. and Mrs. Thorp were allowed to sell Lot 30 four years ago. <br />Community Development Director Grochala stated the City Clerk at that time certified <br />the deed in 1998. That should not have happened and the Council did not approve it. <br />Mr. Joyer stated the sale of this lot is part of the Thorp's long term retirement plan. <br />Community Development Director Grochala stated the subdivision request would have to <br />go through the City process that will also include a variance request. The City needs to <br />make Findings of Fact to support the request. <br />Councilmember O'Donnell inquired about the grandfather clause. Community <br />Development Director Grochala stated this request is excluded from the grandfather <br />clause because the lots were at some point combined. The applicant needs to demonstrate <br />proof that they did not want the lots combined. <br />Acting Mayor Reinert stated he is okay with the subdivision request because they will be <br />using the lots as they were intended. The bigger issue is the variance request. <br />Councilmember O'Donnell stated he would support the subdivision request but needs <br />more information on the variance. <br />Councilmember Carlson stated she is going to visit the area. She stated she is undecided <br />but is hearing solid reasons from staff why the subdivision request should not be <br />approved. <br />Councilmember Dahl stated she is also undecided. The County has to have something to <br />back up their claim that the property owner did request that the lots be combined. <br />Acting Mayor Reinert stated the subdivision is not a big issue because it fits in with the <br />area.
