Access to three of the four lots (Lots 1 through 3) will be provided via an existing <br />private street located east the adjacent McDonald's site. While the Ordinance requires all lots be <br />provided access via a public street access, flexibility to this requirement can be accommodated <br />via the PDO. As part of the City's previous consideration of the McDonald's proposal, a <br />determination was made that access to the subject property would be provided by the existing <br />private street. <br />A cross easement and operation and maintenance agreement will be required as part of the <br />Development Agreement. <br />Lots. The SC District requires a minimum lot size of three acres. Through the PDO however, <br />flexibility to this requirement can be provided without need for a variance. As shown on the <br />preliminary plat, the proposed lots range in size from 1.7 to 2.3 acres. As demonstrated via the <br />submission of site plans, the configuration of the proposed lots are conducive to future <br />commercial development. <br />Utilities. A utility plan has been submitted for review by the City Engineer. Water and Sanitary <br />sewer service were provided to service the site as part of the Lake /Apollo Drive improvement <br />project. As a condition of preliminary plat approval, the utility related modifications and <br />comments as set forth in the City Engineer's memo should to be incorporated into the plans. <br />Grading and Drainage. A grading and drainage plan has been submitted for review by the City <br />Engineer. The plan is also subject to review and approval from the Rice Creek Watershed <br />District. <br />Easements. As shown on the preliminary plat, drainage and utility easements have been <br />proposed along all property lines and over wetland and ponding areas. The acceptability of such <br />easements should be subject to comment and recommendation by the City Engineer. <br />As a condition of final plat approval, cross parking and access easements will need to be <br />recorded with the property. Such easements should be subject to review and approval by the <br />City Attorney. <br />
