Spirit Hills. <br />Page 7 of 9 <br />Comment: The site layout meets standards held within the City's zoning ordinance <br />including turn lanes, access width, and access spacing/location. <br />8. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature <br />of major importance. <br />Comment: The applicant is currently working with the RCWD to satisfy the remaining <br />mitigation requirements through a comprehensive drainage plan for the site, future Ware <br />Road extension and surrounding properties. <br />9. Will conform to specific standards of this ordinance applicable to the particular use. <br />Comment: Each use should conform to the specific standards listed within the General <br />Business section of the zoning ordinance. Specifically, the day care should meet the <br />requirements listed under Section 7 H (11)(a). <br />Environmental Board: The Environmental Board reviewed the proposed development on <br />April 24, 2002 and recommended approval. Their comments are attached and, where applicable, <br />have been incorporated into this report. <br />Rice Creek Watershed District Review: The Rice Creek Watershed District (RCWD) <br />granted a TWAFAA (Table With Authorization For Administration Action) on February 27, <br />2002, pending resolution of Wetland Conservation Act (WCA) issues. <br />The applicant is proposing to fill 8,000 square feet of existing wetland on the site. 3,041 square <br />feet is proposed to be mitigated on -site. The applicant is currently working with the RCWD to <br />satisfy the remaining mitigation requirements through a comprehensive drainage plan for the <br />site, future Ware Road extension and surrounding properties. The wetland delineations have <br />been approved and RCWD has agreed to work with the applicant to create the best solution for <br />wetland impacts and protection. No permit for the work at Spirit Hills will be issued until the <br />overall impacts are addressed during the Ware Road permitting process. <br />Anoka County Highway Department: Anoka County has completed its review of the <br />proposed development. Their comments, dated August 29, 2002, are attached. In general the <br />County is requesting the construction of both westbound and eastbound left and right turn lanes <br />on CSAH 10 (Birch Street). <br />These improvements will need to be constructed in conjunction with the proposed development. <br />The proposed improvements are not included within the City or County Capital Improvement <br />Programs. Therefore, it will be the responsibility of the developer to construct and finance the <br />proposed improvements as a condition of the development approval. <br />Site Improvement Performance Agreement: Prior to the commencement of any site <br />work, the applicant will be required to enter into a performance agreement with the City and post <br />all the necessary securities required by it. <br />
