Spirit Hills. <br />Page 6 of 9 <br />1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or <br />general welfare of the neighborhood or the City. <br />Comment: Bank drive -thru, child day care and service station uses currently exist within <br />the City of Lino Lakes. None of the uses should be detrimental or endanger the public. <br />2. Will be harmonious with the general and applicable specific plans and policies of the <br />comprehensive plan of the City and this ordinance. <br />Comment: The comprehensive plan guides for commercial use of this site. Once rezoned <br />from R -1 to General Business the site would match the comprehensive plan. <br />3. Will be designed, constructed, operated, and maintained so as to be harmonious and <br />appropriate in appearance with the existing and/or intended character of the general <br />vicinity and will not change the essential character of that area. <br />Comment: The building designs include many windows and rock face block. The design <br />will be carried through on all four sides of the buildings. This should help make the <br />buildings more attractive. Landscaping and fencing should soften the development and <br />help screen the use from residents. The added sidewalk should be beneficial for <br />pedestrians. Restrictions on canopy lighting, outside audio, hours of operation, and <br />limited delivery hours will minimize the fueling station impacts to existing residential <br />properties. <br />4. Will be served adequately by essential public facilities and services, including street, <br />police and fire protection, drainage structures, refuse disposal, water and sewer systems, <br />and schools; or will be served adequately by such facilities and services provided by the <br />persons or agencies responsible for the establishment of the proposed use. <br />Comment: The proposal should be served adequately by such facilities and services. <br />5. Will not create excessive additional requirements at public cost for public facilities and <br />services and will not be detrimental to the economic welfare of the community. <br />Comment: This development should not increase public costs, nor be detrimental to the <br />economic welfare of the community. <br />6. Will not involve uses, activities, processes, materials, equipment and conditions of <br />operation that will be detrimental to any persons, property, or the general welfare <br />because of excessive production of traffic, noise, smoke, fumes, glare, or odors. <br />Comment: The proposed commercial uses upon this site should not create any excessive <br />externalities that would be abnormal to the character of commercial sites. <br />7. Will have vehicular approaches to the property which are so designed as not to create <br />traffic congestion or an interference with traffic on surrounding public thoroughfares. <br />
