• <br />• <br />• <br />WHEREAS, the City Subdivision Ordinance and Minnesota Statute 462.358 authorize <br />the City to enter into a performance contract secured by cash escrow or other security to <br />guarantee completion and payment of such public and private improvements. <br />NOW, THEREFORE, in consideration of the mutual promises of the parties made <br />herein, <br />IT IS AGREED BY AND BETWEEN THE PARTIES HERETO: <br />1. DEVELOPMENT. The Development Property shall be developed with commercial and <br />retail businesses in accordance with this agreement, (the "Project "), Resolutions 02 -111 <br />and 02 -112, and all state, county, city and other governmental regulations which may be <br />applicable thereto. The development will be known as the "JADT Addition." <br />Improvements to be installed at the Developer's expense by the Developer are hereinafter <br />referred to as "Developer Improvements." <br />2. DEVELOPMENT PLANS. <br />A. The Developer shall submit to the City for review and approval a Final <br />Development Plan set and specifications ( "Development Plans ") for the <br />Development Property. Such Development Plans shall be in general conformance <br />with the Preliminary Plans as set forth in Resolutions 02 -111 and 02 -112 <br />approved by the City on September 9, 2002. Such Development Plans shall <br />include : <br />1. Final Plat <br />2. Development Site Plan <br />3. Development Utility Plan <br />4. Development Grading Plan <br />5. Development Tree Preservation Plan <br />6. Development Landscaping Plan <br />7. Development Lighting Plan <br />8. Lighting, Landscaping and Civil details and specifications <br />9. Lot 4, Block 1, Building Elevations <br />B. All of the above - referenced Development Plans must be approved by the City <br />prior to their implementation, which approval will not be unreasonably withheld <br />or delayed. Within 10 working days after receipt of the plans from the Developer, <br />the City shall notify Developer in writing of its approval, approval with <br />conditions, or disapproval of the plans. Any plans which are not approved with <br />conditions or disapproved within 10 working days after receipt by the City shall <br />be deemed approved. Once approved, the Developer shall develop the <br />Development Property in substantial accordance with said approved Final Plans. <br />JADT AGREEMENT 2 <br />10/09/02 <br />
