AGENDA ITEM 7A(i) <br />STAFF ORIGINATOR: Michael Grochala <br />CITY COUNCIL <br />MEETING DATE: December 9, 2002 <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />Consider 2"d Reading of Ordinance 08 -02 Rezoning <br />Land from R -1, to GB/PDO <br />4/5 for Ordinance 08 -02 <br />The City Council, approved the First Reading of Ordinance 08 -02, rezoning the property <br />from R -1, Single Family Residential to GB, General Business/ PDO, Planned <br />Development Overlay, for the Spirit Hills Commercial Center, on November 25, 2002. <br />The City Council also approved Resolution No. 02 -88 Approving Site and Building <br />Plans, with conditions, and Conditional Use Permits for a Motor Fueling Station, <br />Accessory Drive - through and Day Care Facility on November 25, 2002. <br />The November 25, 2002 approvals corresponded with the expiration of the City's <br />deadline for agency action. As such the approvals are in effect. However, procedurally, <br />in accordance with City Charter provisions, it is necessary to proceed with the 2°d <br />Reading of the Ordinance and subsequent publication. <br />As previously indicated, the applicant has requested the rezoning of the subject property <br />(Outlot A, Spirit Hills) from R -1, Single Family Residential to GB, General Business/ <br />PDO, Planned Development Overlay. <br />In consideration of rezonings, the City Council must shall consider possible adverse <br />effects of the proposed amendment. Its judgement shall be based upon, but not limited to, <br />the following factors: <br />The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Plan. <br />
