An amendment to the 1997 PDO, Planned Development Overlay for lot <br />area and setback flexibility. <br />2. The rezoning of an additional area of .25 acres to encompass the multi- <br />family area with a legal description provided prior to final plat. <br />3. Plans shall be consistent with Rice Creek Watershed District permit <br />approval or the permit shall be modified. <br />4. The Highland Meadows preliminary plat/PDO subject to the following <br />conditions: <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />g) <br />h) <br />i) <br />j) <br />k) <br />This action is conceptual approval of the townhome development. <br />Final PDO Development Plan approval is subject to the site plan <br />details including unit exteriors, landscaping and floor plans, ownership <br />and maintenance of common areas and submission of association <br />documents. <br />The developer shall overlay Marilyn Dr. to 77th St. and 77"' St. to Lake <br />Dr. to connect where recently reconstructed. <br />The developer shall participate in the cost for improvements completed <br />on 79t St. east of the site. <br />Trails in Outlot A and Outlot C shall be graded and aggregate placed <br />by the developer. <br />Deed restrictions shall be recorded that identify the limited buildable <br />areas of the lots with 50' pads and that no variances shall be granted. <br />Sales information shall include the restricted area for development on <br />all impacted lots as outlined in g. <br />Front yard setbacks for all lots shall be as depicted on the plan with <br />drainage and utility easement dedicated over the setback area on the <br />final plat. <br />A plan clearly identifying front yard setbacks shall be submitted to the <br />building inspector following final plat approval. <br />Outlots B and F shall be deeded to adjacent exceptions. <br />Revegatation of ponding /wetland areas shall include native materials <br />as recommended by the City Environmental Specialist. <br />The submitted grading, drainage, and utility plans are subject to the <br />review and approval of the City Engineer. <br />Issues Analysis <br />Comprehensive Plan/Zoninq <br />The area is located in the Metropolitan Urban Service Area (MUSA) and is <br />designated single family residential on the 1990 land use plan. The site is zoned <br />R -1 and R -3. The Comprehensive Plan and Zoning were modified in 1997 in <br />response to the plan that was proposed at that time. An additional .25 acre of <br />land is proposed to be included in the multi - family area to accommodate the <br />modified layout. The number of units remains the same as the 1997 plan but due <br />to wetland and storm water considerations more land area is needed for the <br />townhomes. <br />
