Hawkins <br />and Associates <br />Memo <br />To: John Powell <br />From: Bill Haw, kinc <br />Date: January 5, 2000 <br />Re: US West Communications Easement <br />Dear John: <br />I have reviewed the proposed easement agreement sent by US West <br />Communications for a permanent easement over a part of the property that the <br />City owns in the former Lino Industrial Park. The area over which they wanted <br />an easement was not included in the re -plat of this area and really has little or <br />no value to the City. I have attempted to obtain a deed from the Schilling but <br />have not had a response to date. This area was included in the original <br />contract for deed under which we purchased the property, however, since it <br />was re- platted but not included in the new plat, it was not included in the <br />warrant deed from the Schillings to the City. <br />Nevertheless, I have no problem with the language in the easement. If you feel <br />the City will have no use for this area in the future, I have no problem with the <br />City Council approving the agreement.
