CITY COUNCIL WORK SESSION MAY 3, 2000 <br />Staff recommended the following regarding this issue: <br />1. <br />Only the improvements north of, and abutting, the proposed bank <br />site will be constructed at this time. This will consist of about 300 feet of <br />roadway and utility construction. <br />2. The City will prepare plans and specifications for these <br />improvements. <br />3. Mr. Schreier will be allowed to contract for, and construct, the <br />improvements as a "developer installed" project. <br />4. The improvements will be turned over to the City after completion <br />and acceptance. <br />Staff noted the challenge regarding the recommendation is recouping the costs and <br />attorney fees incurred to the City for the right -of -way. <br />Mr. Schreier, 2125 DeSoto Street, Maplewood, came forward and stated his only concern <br />with the staff recommendation is being able to keep the pro petflexible for the best <br />possible development. The issue with the service roa l tti the property in two 2 <br />p P � � P P Y (2). <br />He stated it is in everyone's best interest to pursue the staff , econ endation and <br />negotiate the right -of -way issue. <br />Council Member Reinert inquired hdz <br />building the road and the p1ac <br />avd the bank feel about Mr. Schreier <br />Mr. Schreier indicated that hen or of building the road because he can do it quicker <br />and less expensive. He stated h elieves he can work with the bank. <br />Mr. John Millbauer, 7449 Village Drive, Lino Lakes State Bank, referred to the <br />placement of the road and stated that he understands that is his only access. <br />Council Member Reinert noted the only outstanding issue is recouping the attorney fees <br />and cost of the right -of -way. <br />Council Member Carlson added another issue is the vacation of the road. Staff advised <br />they will work up the specifics regarding the vacation of the road and confer with the City <br />Attorney and landowners. <br />Council Member O'Donnell requested clarification regarding the real issue for Mr. <br />Schreier. <br />6 <br />
