COUNCIL MINUTES January 27, 2014 <br />DRAFT <br />4 <br />Council Member Stoesz added that he sees the responsibility of city council members and the mayor 135 <br />to ensure core services t o the citizens. He believes that fire services will be maintained at the highest 136 <br />level and therefore h e can support the withdrawal. 137 <br /> 138 <br />Council Member Rafferty stated that he feels the administration of the CFD should speak equally to 139 <br />all member cities and the right to veto actions seems like it would be in the best interest of all. This 140 <br />isn’t about fire ser vices but about governance and administration. 141 <br /> 142 <br />The motion to approve the resolution was adopted on a unanimous voice vote. 143 <br /> 144 <br />3C) Joint Powers Agreement for Intervention in White Bear Lake Level Lawsuit – 145 <br />Administrator Karlson reviewed the situation where by a White Bear Lake group is suing the 146 <br />Minnesota Department of Natural Resources for water violations. Ten cities are named in the lawsuit 147 <br />as well, including the city of Lino Lakes. The idea of the ten cities joining together to form a joint 148 <br />powers orga nization has come forward. Co st allocation to cities has been discussed and would be 149 <br />based on population and water allocation. He noted that intervention is questionable for some 150 <br />reasons: costs are uncertain; some cities have already declined the optio n to participate. 151 <br /> 152 <br />Mayor Reinert remarked that the matter was discussed at the pre -council work session. As 153 <br />background, the lake level of White Bear Lake is going down and a lawsuit has resulted against the 154 <br />DNR. The council is hearing that there are man y questions unanswered about joining this group and 155 <br />what is at the end is unknown. He fears that getting involved would be like throwing money at a 156 <br />wild card. Furthermore the DNR is officially on the case. 157 <br /> 158 <br />Council Member Roeser noted that he feels the lawsuit will be long term and there are different 159 <br />o ptions down the line to get the water level up. He is concerned about politics driving the issue and 160 <br />he would encourage people concerned about water issues to talk to the DNR. 161 <br /> 162 <br />Council Member Roeser move d that the City not participate in the intervention group. Council 163 <br />Member Kusterman seconded the motion.
