otherwise bring the property the ambit of, CERCLA, or any <br />similar state law or _local ordinance, or (iii) the <br />discharge of pollutants or effluents into any water <br />source or system,•the dredging or filling of any waters <br />or the discharge into the air of any emissions, that <br />would require a permit under the Federal Water Pollution <br />Contract Act, 33 U.S.C. S1251 et seq., or the Clean Air <br />Act, 42 U.S.C. 4701 et seq., or any similar stat law or <br />local ordinance. To the best of Seller's knowledge, <br />there are no substances or conditions in or on the <br />property that may support a claim or cause of action <br />under RCRA, CERCLA or any other federal, state or local <br />environmental statues, regulations, ordinances or other <br />environmental regulatory requirements, including without <br />limitation, the Minnesota Environmental Response and <br />Liability Act, Minn. Stat. §115B ( "MERLA ") and the <br />Minnesota Petroleum Tank Release Cleanup Act, Minn. Stat. <br />§115C. <br />6. Survival of Terms. The representations and warranties <br />contained in this Agreement shall survive the closing of the <br />transaction contemplated herein and shall not be merged in the <br />closing documents. <br />7. Condition of Property. The premises are sold as is with <br />no warranties on the part of either party except warranties <br />specifically set forth herein. The parties further acknowledge <br />that the nature and scope of its investigation is solely within the <br />discretion of each and that any matters that are not disclosed <br />
