MEETING DATE: June 26, 2000 <br />TOPIC: Site & Building Plan Review <br />PUBLIC HEARING: Conditional Use Permit <br />Dairy Queen, 21st Ave. at Northern Lights Blvd. <br />ACTION: 3/5 vote <br />BACKGROUND <br />The application includes a site plan and conditional use permit for a new Dairy Queen on <br />21St Ave. at Northern Lights Blvd. The site is zoned GB General Business. Restaurants <br />with a drive - through facility require a conditional use permit in the GB district. <br />This site is part of a preliminary plat that was approved by the City in December 1997. <br />No final plat was approved. It is best to clean up this situation by requiring that a final <br />plat be approved as a condition of approval for the Dairy Queen. To this end, this report <br />addresses the site plan, CUP, and also discusses platting issues. <br />The applicant for the Dairy Queen project is not the landowner who is responsible for the <br />platting requirements. However, the plat issues must be resolved before additional <br />development occurs. Staff did not bring this project to City Council immediately after <br />the hearing at the Planning & Zoning Board. We were hoping the plat issues could be <br />resolved sooner so that several conditions of approval could be eliminted.
