AGENDA ITEM 7D <br />STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: August 28, 2000 <br />TOPIC: Apollo Business Center, Conditional Use Permit <br />VOTE REQUIRED: 3/5 Vote Required <br />BACKGROUND: <br />G.M. Development (Gary Uhde) is developing an area known as the Apollo Business <br />Center located east of Jon Avenue, between the 74th Street alignment and I -35W. Maps <br />showing this area are attached. Within this area; the Blue Heron and Contract Hardware <br />sites have been developed, the H & L Mesabi site plan has been approved for <br />development, and the Twin City Fab (parcel D) and Marmon /Keystone (parcel E) sites <br />have submitted site plans for review. <br />Trunk sanitary sewer and water provided service to this area of the City about 10 years <br />ago as part of the West Central Trunk project. Construction of Apollo Drive through this <br />site took place in 1993 and 1994. Apollo Drive is an Anoka County roadway (CSAH 12) <br />and was constructed through a Joint Powers Agreement between the City and Anoka <br />County. It was designed to comply with County and State Aid design standards. To <br />accommodate proper design of the storm sewer system, the roadway had to be raised <br />above the surrounding elevations. <br />In order to provide fill to be sold to the Apollo Drive contractor, borrow pits were created <br />in the Apollo Business Center. It was expected these pits would later be utilized as <br />storm water pond sites. In order to modify the location and depth of the excavations, <br />and to provide fill for the proposed building sites on parcels D and E, the developer <br />expects to move in excess of 80,000 cubic yards of material. Section 12.B of the City's <br />Zoning Ordinance states "When five thousand (5,000) or more cubic yards of material is <br />to be removed or deposited on any lot or parcel, a conditional use permit shall be <br />required ". Based on ownership of five parcels, the applicant is able to move 25,000 <br />cubic yards of material without a CUP. However, in order to allow the site grading to <br />continue, a CUP must be obtained. <br />The proposed plan is consistent with the site plans that have been submitted for Twin <br />City Fab and Marmon /Keystone. The CUP grading plan does not include detailed <br />landscaping information which has, or will be, provided with the site plan applications for <br />the individual sites. <br />The proposed grading plan includes fill, excavation, storm sewer construction, and <br />wetland alteration. Rice Creek Watershed District (RCWD) is the LGU in this part of the <br />City and has the responsibility for reviewing the proposed wetland alterations. The <br />RCWD has reviewed the proposed grading and wetland alteration and authorized permit <br />
