The conditions of the City Engineer’s memo (dated 8 /9 /02) related to grading, <br />drainage and utilities be satisfied. <br />12. The following modification be made to the landscape plan: <br />a.The Little Leaf Linden trees along A pollo Drive be changed to a Red or <br />White Oak and spaced at 50 feet. <br />b.Overstory trees be incorporated into the plaza fronting the building <br />replacing the proposed unidentified plantings. <br />c.The coniferous trees along I-35 be changed to Austrian Pine and White <br />Spruce. <br />d.The proposed Purpleleaf Plum trees be changed to disease resistant <br />ornamental crab trees. <br />e.Plantings within the limits of the east ponding area be eliminated. <br />f. Tamerack Trees be provided around th e east ponding area (to tie into the <br />Marketplace development) and be located above the 100 year HWL. <br />13. A revised master landscaping plan, enco mpassing the entire subdivision, should <br />be submitted for City review and appr oval. The plan should demonstrate <br />conformance with the tree replacemen t requirements for the development. <br />14. A Watershed District Permit be received prior to City building permit issuance. <br />15. Prior to the commencement of any site work, the applicant enter into a <br />development agreement with the City and post all the necessary securities <br />required by it. The agreement shall also contain and operation and maintenance <br />agree <br />16.That applicant get an a ccess easement to the South from the Kohl’s property <br />regarding the eastern access off of Apollo. <br />17. Shrubs may be used in the pla za area instead of trees as proposed. <br />C.Conditional Use Permit approval to allow an accessory drive-thru facility subject <br />to the following conditions: <br />1. The City approves the JADT Addition final plat. <br />2. The City approves the submitted site and building plans. <br />Mr. Lyden asked if they would be able to see thr ough the circle at the top of the building. <br />Mr. Kirmis stated he was not sure, but they could add that as a condition. <br />Mr. Lyden asked what the drive through was pr oposed to be. Mr. Kirmis replied it was a <br />Caribou Coffee. <br />Chair Schaps invited applicant to make comments.
