Planning & Zoning Board <br />October 14, 2009 <br />Page 4 <br />APPROVED MINUTES <br />Mr. Laden made a MOTION to amend the restricted hou rs of operation under Tier C to <br />“Between the hours of 9 p.m. and 7 a.m. no customer s or employees…” Motion was <br />supported by Mr. Root. Motion carried 4-3. (Brady , Pogalz and Hyden voting nay.) <br /> <br />Staff explained that the reason for charging a perm it fee for Tier B is to cover the <br />administrative time to verify the applicant address , confirm the requirements of the <br />proposed use, and enter the permit information into a database tracking system. A site <br />visit would require additional time by the city bui lding official if necessary. <br /> <br />Mr. Laden asked if it would be possible to charge a fee only if a site visit is required. <br />Staff replied that they would have to establish a t hreshold for determining when a site <br />visit would be required. Mr. Tralle commented that a split in fees may create problems. <br /> <br />Mr. Nelson wondered why the city should even track home occupations falling under <br />Tier B. Staff replied that anytime a customer or e mployee enters a building they should <br />be assured of life-safety codes. <br /> <br />Mr. Nelson made a MOTION to remove the issuance of a permit and fee for Tier B. <br />Motion was supported by Mr. Laden. Motion carried 4-3. (Pogalz, Brady and Root <br />voting nay.) Board members commented that even tho ugh no permit will be required, <br />they believe it is a good idea to have regulations in place and clarity as to what is <br />allowed. <br /> <br />Mr. Nelson made a MOTION to close the Public Hearin g at 7:46 p.m. Motion was <br />supported by Mr. Hyden. Motion carried 6-0. <br /> <br />Mr. Nelson made a MOTION to recommend approval of A mending the Zoning <br />Ordinance to clarify requirements for Home Occupati ons, and Residential <br />Storage/Parking. Motion was supported by Mr. Laden . Motion carried 4-2. (Pogalz and <br />Brady voting nay.) <br /> <br />VI. DISCUSSION ITEMS <br /> <br />A. Comprehensive Plan Update <br /> <br />Mr. Bengtson gave the board an update that the plan was submitted to the Metropolitan <br />Council in August. Staff met with the Met Council to discuss questions and submitted <br />additional information to Met Council as requested. <br /> <br />B. Governor Declares “Community Planning Month” <br /> <br />Mr. Bengtson stated that the month of October is Na tional Community Planning Month. <br />Included in the board member packets was a Proclama tion signed by Governor Tim <br />Pawlenty declaring October as Community Planning Mo nth in the State of MN. <br /> <br />VII.
