Ms. Brady made a MOTION to close the Public Hearing at 7:06 p.m. Motion was supported by Mr. Pogalz. Motion carried 6-0. Mr. Pogalz made a MOTION to recommend approval of t he Amendment to the Planned Unit Development for Legacy at Woods Edge to modify the Lino Lakes Town Center Design and Development Guide Land Use Plan and the requirements for assisted living facilities in the Mixed Use District. Motion was s upported by Mr. Nelson. Motion carried 6-0. B. CONTINUED PUBLIC HEARING to consider amending the Z oning Ordinance to clarify requirements for Home Occupati ons, and Residential Storage/Parking Associate Planner Paul Bengtson presented the staff report, addressing any changes made since the September meeting. Under the Home Occupation Section, staff drafted am endments to the hours of operation, the number of allowed business trips, and the numbe r of allowed delivery trips. A number of board members agreed that the proposed allowable hours were too restrictive. They commented that there should be s ome allowance for evening hours. Since there is a limit to the number of trips, they don’t feel it necessary for the city to be unnecessarily restrictive with the hours. Other board members thought that strict boundaries are necessary to encourage home businesses to be good neighbors. They considered t he importance of preserving the residential area, and felt that if a business gets to a point that they need to accommodate more customers at later hours, it may be time to ge t a building to conduct their business. Board Members discussed whether Tier B should requi re a permit and/or a fee. Some members agreed that it is restrictive enough for th e city to enforce requirements and regulations without requiring a permit or a fee. O ther members felt there needs to be teeth in an ordinance for it to be effective. Staff reminded the board that requirements should b e measurable and not open to interpretation. Under Parking Regulations, staff added text to allo w for environmentally-friendly surface options. Staff combined trailers with recreational vehicles, and added text to prohibit the use of recreational vehicles as living quarters whi le parked on a property. There were no new proposed changes to the area of E xterior Storage since the last meeting.
