Motion carried 6-0. <br /> <br />Mr. Pogalz made a MOTION to recommend approval of t he Amendment to the Planned <br />Unit Development for Legacy at Woods Edge to modify the Lino Lakes Town Center <br />Design and Development Guide Land Use Plan and the requirements for assisted living <br />facilities in the Mixed Use District. Motion was s upported by Mr. Nelson. Motion <br />carried 6-0. <br /> <br />B. CONTINUED PUBLIC HEARING to consider amending the Z oning <br />Ordinance to clarify requirements for Home Occupati ons, and Residential <br />Storage/Parking <br /> <br />Associate Planner Paul Bengtson presented the staff report, addressing any changes made <br />since the September meeting. <br /> <br />Under the Home Occupation Section, staff drafted am endments to the hours of operation, <br />the number of allowed business trips, and the numbe r of allowed delivery trips. <br /> <br />A number of board members agreed that the proposed allowable hours were too <br />restrictive. They commented that there should be s ome allowance for evening hours. <br />Since there is a limit to the number of trips, they don’t feel it necessary for the city to be <br />unnecessarily restrictive with the hours. <br /> <br />Other board members thought that strict boundaries are necessary to encourage home <br />businesses to be good neighbors. They considered t he importance of preserving the <br />residential area, and felt that if a business gets to a point that they need to accommodate <br />more customers at later hours, it may be time to ge t a building to conduct their business. <br /> <br />Board Members discussed whether Tier B should requi re a permit and/or a fee. Some <br />members agreed that it is restrictive enough for th e city to enforce requirements and <br />regulations without requiring a permit or a fee. O ther members felt there needs to be <br />teeth in an ordinance for it to be effective. <br /> <br />Staff reminded the board that requirements should b e measurable and not open to <br />interpretation. <br /> <br />Under Parking Regulations, staff added text to allo w for environmentally-friendly surface <br />options. Staff combined trailers with recreational vehicles, and added text to prohibit the <br />use of recreational vehicles as living quarters whi le parked on a property. <br /> <br />There were no new proposed changes to the area of E xterior Storage since the last <br />meeting. <br />
