Mayor Bergeson inquired about any liability issues with the use of these devices. Staff advised the Police <br />Department has changed its police pursuit policy to comply with current legislation. <br />The City Administrator asked for clarification regarding uniforms. Staff advised the resolution is correct <br />',regarding the issue of uniforms. <br />Council Member Dahl moved to adopt Resolution No. 2000 - 75, as presented. Council Member Reinert <br />seconded the motion. Motion carried unanimously. <br />Resolution No. 2000 - 75 can be found in the City Clerk's office. <br />PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />There was no Public Services Department report. <br />COMMUNITY DEVELOPMENT DEPARTMENT REPORT, BRIAN WESSEL <br />PUBLIC HEARING, Resolution No. 00 - 64, Adopt Assessment Roll, Twilight Acres 1St and rd <br />Additions, John Powell - Staff advised the public hearing for this item is continued from the July 24, 2000, <br />City Council meeting. Many residents made statements and asked questions about the proposed assessment <br />amounts, the Public Improvement process (Statute 429), and the City Charter. Specific information from the <br />City Attorney and Charter Commission was requested in order to clarify the 60 -day waiting period status. City <br />staff has received and distributed opinions from both the City Attorney and the Chair of the Charter <br />Commission regarding this issue. <br />A resident also indicated he had contacted the Metropolitan Council and the Minnesota Pollution Control <br />Agency and received assurance there were funds available for this type of project. City staff again contacted <br />•both of these agencies and the Minnesota Department of Health regarding grant funding availability specifically <br />to help pay assessments for connection to City utilities. Staff was unable to identify alternative funding sources. <br />Many of the funding sources relate to replacement of on -site systems, low interest loans, or have income <br />restrictions. <br />The first meeting of the Twilight Acres Work Group regarding the septic systems was held last Thursday <br />evening, August 10, 2000, with several residents, the City Administrator, and City Engineer. The group <br />specifically asked that the following issues be considered: <br />1. Another survey to determine the level of the resident's willingness to pay for this project. <br />2. Placing the project on the ballot this fall for consideration. <br />3. Making a specific funding request to an agency other than the City. <br />4. Modifying the project to include alternative means of providing utility service. <br />Staff will need time to investigate these issues and report to the City Council. Staff recommended continuing <br />the public hearing at least until the August 28, 2000, Council meeting. <br />Council Member Reinert asked if City staff had contacted the individuals that residents indicated they had <br />spoken to about funding. Staff advised they contacted two individuals that Mr. Bye had indicated he spoke <br />with. Two representatives from the Minnesota Pollution Agency and the Department of Health were contacted. <br />There is funding available for failing septics.
