Since we <br />do not know how many lots will ultimately be created, staff is comfortable with the <br />number of lots on the submitted final plat. <br />2. Complete development agreement <br />3. Financial securities as described in the development agreement <br />This is an unusual situation in that improvements were installed several years ago without <br />a development agreement or financial securities. The City Attorney and City Engineer <br />have been negotiating with the developer regarding the costs of the various elements of <br />the plat. Negotiations are nearly complete. We expect that by the time of the November <br />13 meeting the parties will have agreed to the terms of the development agreement, <br />including any financial securities. <br />4. Title commitment approval by City Attorney <br />The City Attorney is reviewing the title submittal. We will have the result of his review <br />• by the November 13 meeting. <br />5. Conditions of approval must be met <br />The conditions of approval have been satisfied. Conditions regarding the floodplain were <br />to be amended as the previous agenda item at tonight's meeting. <br />OPTIONS <br />1. Approve the final plat.
