COUNCIL MINUTES AUGUST 28, 2000 <br />Mr. Krause has submitted a sketch indicating that he has a heavily wooded lot with a drainage ditch <br />and wetland area in the north/west corner. He has limited space for this proposed structure as his <br />drain field and septic tank occupies the south/east corner of his property. In review of the site, staff <br />concurs that there is a hardship created by the lay of the land. A letter has been submitted by the <br />adjoining property owner, to the north, indicating no objections to the location of the accessory <br />structure in front of the home. <br />For Council information, Wood Duck Trail was recently added to the City's State Aid roadway <br />system. Although the proposed structure is located 40 feet from the front property line, the City may <br />need an additional 10' of right -of -way for future road reconstruction. This is not anticipated in the <br />near future but staff would recommend that the proposed structure be moved 10' westerly to allow for <br />this future reconstruction and maintenance of the required 40' setback at that time. <br />The Planning and Zoning Board reviewed this item at their August 9, 2000, meeting and <br />recommended approval of this variance based on conditions. <br />Council Member Reinert moved to approve the variance as req �> to • ase �• n the following <br />conditions: <br />1. The accessory building is located <br />Duck Trail. <br />Council Member O'Donnell seconded t <br />the urrent front property line on Wood <br />otion carried unanimously. <br />Minor Subdivision, Steve Benes = La e Drive (3/5 Vote Required), Mary Kay Wyland — <br />Staff advised Steve Benesch is r s a minor subdivision at 8251 Lake Drive that would add a <br />1,777 square foot triangle (2 to existing parcel of property in order to correct an <br />encroachment onto the n created when a garage slab was placed over the property <br />line. The property owner 6 "A.Y a e Drive, Dave & Debbi Stoppelman, have agreed to sell this <br />triangular parcel to Mr. Be n ch." The Stoppelman parcel is a "flag lot" with a 50' x 255' strip of <br />property leading to a larger, ` :6' x 308' parcel. Their total parcel is 2.35 acres in size. The driveway <br />is located on the northerly side of the 50 strip of property. Mr. Benesch's parcel is .72 acres in size. <br />The properties in question are currently Zoned Rural and guided for low density sewered residential <br />development in the draft Comp Plan. The two (2) parcels under consideration were created prior to <br />establishment of the 10 acre minimum and are considered pre- existing non - conforming lots of record. <br />The triangular piece to be split from one parcel and given to the other is insignificant in comparison to <br />the overall rural lot minimum requirements. <br />The adjoining property owners have agreed to sell the triangular piece of property to Mr. Benesch. It <br />does not appear that the existing driveway to the Stoppleman home will be adversely affected by the <br />location of the garage and Mr. Benesch has limited space for relocation of the slab. The proposed • <br />garage slab will meet all setback requirements with approval of this subdivision, as the structure will <br />be 5' from the side property line and more than 40' from the front property line.
