He also asked if the County will eventually need additional right -of -way. City Planner Smyser advised the setback will be 10 feet, which is the reason for the variance. City Engineer Powell added that the roadway is a County road. The County has commented on the variance request and indicated they have no current plans for reconstruction. City Planner Smyser advised that Anoka County has informed the City that it foresees the need for an additional five -(5) feet of right -of -way on each side of the road. If this occurs, the garage and driveway will be only five (5) feet from the ROW. While this is an undesirable situation, it is a tradeoff between being closer to the road and filling more wetland. The City cannot simply prevent the property owner from using the land. Council Member O'Donnell moved to adopt Resolution No. 01 — 8 =v° on the following conditions: 1.
