ANALYSIS <br />Minor Subdivision: Resolution 01 -112 <br />Exhibit D shows the existing lots and ownership. The Junes property currently includes <br />two separate lots under the Junes' ownership. The Rehbein property currently is one lot. <br />The proposed minor subdivision (Exhibit E) will do several things, including: <br />• Split 1.67 acres from the eastern lot owned by the Junes (Parcel C). This leaves <br />6.18 acres to be retained by the Junes. <br />• Split a total of 0.51 acre from both Junes lots to dedicate as additional right of <br />way for 62nd St. (Parcel D). <br />• Split the Rehbein lot into two lots, a 1.0 acre piece with the house (Parcel G), and <br />an 8.71 piece (Parcel F). <br />• Split 0.3 acre from the Rehbein lot, to dedicate as additional right of way for 62nd <br />St. (Parcel H). <br />Staff is recommending the following actions as well: <br />• Combine Parcels C and F with the existing Carlson property to make one parcel. <br />• Combine the Junes property into one parcel (Parcel B). <br />The result of the minor subdivision will then be three parcels, one each owned by Junes, <br />Rehbein, and Carlson. <br />The minimum lot size under existing zoning is 10 acres. However, the zoning ordinance <br />allows the following: <br />Habitable single family homes constructed prior to July 13, 1992 may reduce their <br />lot size to a minimum of one (1) acre if the balance of the property results in a <br />parcel of ten (10) acres, or is serviced by public sewer, and it can be demonstrated <br />by means satisfactory to the City that the division will not result in ground water, <br />soil or other contamination which may endanger the public health. <br />Section 3 Subd. 3.A.2.b.2) <br />Both the Junes and Rehbein homes meet the date criterion. Both subdivisions meet the <br />minimum one acre requirement for the house lot. The remaining land broken off from <br />the each house lot will be incorporated into the 19 -acre West Shadow Ponds plat. Thus, <br />the minor subdivision is contingent upon the plat because the "balance of the property" <br />must be at least ten acres. The plat is contingent upon the minor subdivision because the <br />additional land is needed for the plat. <br />Staff is recommending approval of Resolution 01 -112 which approves the minor <br />subdivision as submitted, with the condition that Parcels C and F are not buildable lots <br />• <br />
