THIS grant contract, and amendments and supplements thereto, between the State of Minnesota, acting through <br />its Department of Public Safety, Division of Emergency Management (hereinafter STATE) and City of Lino <br />• Lakes, an independent contractor, not an employee of the State of Minnesota, address 640 Town Center <br />Parkway, Lino Lakes, MN 55014 (hereinafter GRANTEE), witnesseth that: <br />WHEREAS, the STATE, pursuant to Minnesota Statutes § 12.22, is empowered to allocate and disburse federal <br />aid made available through the United States Department of Transportation; and <br />WHEREAS, the purpose of the Hazardous Materials Emergency Preparedness (HMEP) Grant Program, Catalog <br />of Domestic Assistance No. 20.703, is to reimburse expenses of organizations and local units of government <br />associated with the start-up, improvement and implementation of local planning advisory committees, the <br />exercising of emergency response plans, and conferences relating to hazardous materials planning and response; <br />and <br />WHEREAS, GRANTEE represents that it is duly qualified and willing to perform the services set forth herein; <br />NOW, THEREFORE, it is agreed: <br />I. GRANTEE'S DUTIES (Attach additional page if necessary which is incorporated by reference and <br />made a part of this agreement.) GRANTEE shall perform the services and tasks for a Exercise, as <br />submitted and approved by the STATE in GRANTEE'S grant application, which is hereby <br />incorporated by reference, labeled Attachment A, and made a part of this agreement. <br />II. CONSIDERATION AND TERMS OF PAYMENT <br />A. Consideration for all services performed by GRANTEE pursuant to this grant contract shall be <br />paid by the STATE as follows: <br />1. Compensation shall not exceed Five Hundred Eighty Five dollars ($585.00), and shall be in <br />compliance with itemized categories approved by the STATE in GRANTEE'S grant application. <br />If additional Hazardous Materials Emergency Preparedness (HMEP) funds become available <br />and/or are reallocated to the STATE during the federal fiscal year, the STATE may increase the <br />GRANTEE'S grant reimbursement under this grant contract by encumbrance. This shall be done <br />using the Grant Adjustment Notice Re- obligation form; a sample of this form is attached to this <br />agreement and labeled Attachment D. Any additional funds will be governed by this grant <br />contract and any amendments to this grant contract. <br />2. Matching Requirements. (If Applicable) GRANTEE certifies that the following matching <br />requirement, for the grant, will be met by GRANTEE: None <br />3.
