HOKAN <br />January 14, 2004 <br />City of Lino Lakes <br />Planning & Zoning Board <br />City Council <br />600 Town Center Parkway <br />Lino Lakes, MN 55014 <br />RE: Rezone — Lake Drive and Aqua Lane <br />Dear Board and Council, <br />.:LO P <br />1 <br />Hokanson Family Partnership requests that the City of Lino Lakes deny the application <br />to modify and rezone the property located at the northeast corner of Aqua Lane and <br />Lake Drive. We are opposed to the proposed zoning change. As the property owner <br />impacted directly by this, we request that you deny this rezone application based on the <br />following concerns: <br />1. The adjacent Marshan Lake Condominiums to the north and east are currently <br />zoned High Density. There are also higher density lands to the west and <br />commercial zoning to the south. The Comprehensive Plan classifies the existing <br />Marshan Development as Medium Density when it is clearly High Density. <br />Therefore, the Comprehensive Plan treats the 4 acre site and the existing site as <br />one singular guided classification, i.e. medium density, even though both are <br />classified as high density on the zoning map. The down zoning of the subject 4 acre <br />property would not be considered typical zoning practice since it is a form of spot <br />zoning. The subject four acre site is located at the intersection of an arterial road; <br />typically these areas have a more intense land use than surrounding uses, rather <br />than less intense. <br />2. The entire Marshan Lake Condominiums site including the subject 4 acre property <br />are both guided as Medium Density Residential based on the current <br />Comprehensive Plan; this guidance for existing Marshan is incorrect due to the built <br />density. The Marshan Lake Condominiums site was developed as a high- density <br />development and continues to be a high- density in use, even under the current <br />guiding of medium density. It clearly exceeds 6 dwelling units per acre. As stated <br />on page 86 of the comprehensive plan, High = 6 to 12 units per acre. The <br />developed Marshan Lake Condominiums are not consistent with the current <br />Comprehensive Plan because its density is more than 6 dwellings per acre.
