• <br />City Council <br />Legacy at Woods Edge <br />March 22, 2004 <br />1' <br />Design & Development Standards <br />Ordinance 04 -04 establishes the Lino Lakes Town Center Design & Development Guide <br />as the regulatory zoning standards for the Legacy at Woods Edge development. The <br />standards establish the use, site layout, site amenity and architectural control guidelines <br />for the Planned Unit Development. The Ordinance also provides that unless specified <br />in the development guide the project is subject to the Zoning Ordinance and all other <br />applicable chapters of City Code. <br />Staff has made some minor changes to the standards since the 1st reading of the <br />ordinance. These changes relate specifically to Section 3.1, Allowable Uses. The <br />purpose of the changes was to eliminate conflicts between the zoning ordinance and <br />Development Guide for similar uses and to provide clarity to the evaluation criteria for <br />conditional uses. The proposed changes are identified in the attached Table 1 from <br />Section 3.1 of the Design Guide and the new Appendix A, entitled Conditional Uses. <br />FINDINGS <br />Rezoning to Planned Unit Development. The City shall consider possible adverse <br />effects of the proposed amendment and its judgement shall be based upon, the criteria <br />established in Section 2, Subdivision 1.E. of the Lino Lakes Zoning Ordinance. <br />1. The proposed rezoning is consistent with the specific policies and provision of <br />the City's Comprehensive Plan. <br />2. The proposed mixed use development is compatible with present and future land <br />uses of the area. <br />3. The proposed development conforms to all performance standards contained <br />within the zoning ordinance. <br />4. The proposed use can be accommodated with existing public services and will <br />not overburden the City's service capacity. <br />5. Traffic generation by the proposed use is within capabilities of streets serving the <br />property subject to the roadway improvements proposed for the development <br />and Lake Drive. <br />RECOMMENDATION <br />The intent of the rezoning to Planned Unit Development and the approval of the <br />Development Stage Plan is to establish the overall regulatory framework, unique to the <br />development, while allowing flexibility for individual site design. It is anticipated that <br />modifications to building size, number and placement will happen as the project <br />develops. However, such modifications will be subject to the requirements set forth in <br />the Design Standards. <br />There are several steps in the process that will commence following approval of the <br />rezoning and Development Stage Plan. These include, but are not limited to, <br />preparation and evaluation of the public improvement feasibility study, financial <br />
