Eagle Brook Church <br />page 12 <br />retail development will generate far more traffic than the proposed church, and retail peak <br />times typically correspond with rush hour —the peak times on the freeway. <br />This is why the level of service restrictions do not apply to the interchanges. <br />However, this does not mean that the City should ignore traffic impacts on the <br />interchange area if a clear public safety issue arises. The traffic analysis for the EAW <br />addressed Sunday worship service times. In December 2003, staff instructed the <br />applicant to expand that analysis to address planned Saturday evening services and the <br />possibility of weekday services. (The church's current programming plan does not <br />include weekday services. However, we are assuming they are possible in the future.) <br />Since then, we received additional analysis. Subsequently, City staff met with <br />representatives of the church and the neighborhood group several times to refine the <br />analysis. The latest analysis concluded that during peak periods there will be delays on <br />CSAH 14 and CSAH 21, there will be congestion, but there is no clear public safety <br />issue. Vehicles will not stack back into the travel lane of I -35E, which was the primary <br />concern. Several conditions of approval will mitigate traffic impacts. <br />Conditional Use Permit Criteria <br />There are general criteria for all CUPs and specific conditions that apply to churches, as <br />listed in Section, Subd. 2.7 of the zoning ordinance. <br />General Criteria: The Planning and Zoning Board shall recommend a conditional <br />use permit and the Council shall order the issuance of such permit only if it finds the <br />following criteria have been met: <br />a. The proposed development application has been found to be consistent with the <br />policies and recommendations of the Lino Lakes Comprehensive Plan including: <br />Land Use Plan, Transportation Plan, Utility (Sewer and Water) Plans, Local Water <br />Management Plan, Capital Improvement Plan, Policy Plan, Natural Environment <br />Plan. <br />• While there are no specific statements or policies in these plans with which <br />the proposed project clearly conflicts, the safety of the traveling public is an <br />underlying concern. In the Policy Plan chapter, under Land Use, general <br />policy 9. is "Relate land use development to transportation systems of the City <br />as identified in the Lino Lakes Comprehensive Transportation Plan." In <br />relating the proposed development to the transportation system that serves the <br />City, the traffic analysis does not reveal a clear danger to public safety. <br />b. The proposed development application is compatible with present and future land <br />uses of the area. <br />• The site is guided for single family sewered development. This does not <br />exclude churches, which typically are in single family zones.
