MEMORANDUM <br />DATE: March 19, 2004 <br />TO: City Council <br />FROM: Michael Grochala <br />RE: HERON Group Request <br />Conditions for CUP <br />March 19, 2004 <br />City staff received the attached letter, dated March 19, 2003, today which requests <br />consideration of proposed conditions to the Conditional Use Permit. Staff has reviewed <br />this in conjunction with the proposed conditions in the staff report. Our comments are as <br />follows: <br />1. Protect and support the Blue Heron Rookery. <br />a. The proposed conservation easement must be legally in place before any grading <br />or building permit would be granted. <br />Comment: Condition No. 20 of Resolution No. 04 -17 requires that the <br />easement agreement be completed prior to the issuance of a building permit. <br />b. The church would prohibit any human activity within the conservation easement <br />during the heron nesting season, which is defined as between April 1 through <br />August 1 of each year. One exception: observation by County and State <br />naturalists may be allowed. <br />Comment: Condition No. 20 of Resolution No. 04 -17 requires that Access to <br />the Conservation Easement Area be restricted and /or prohibited during the <br />nesting season of the Great Blue Herons and other significant waterfowl. Access <br />may be granted for observational and/or research purposes. Access will also be <br />permitted for maintenance and management purposes. <br />The proposed Conservation Easement Management Plan, prepared by Eagle <br />Brook Church, specifies this language. <br />c.
