Memorandum <br />Date: April 7, 2004 <br />To: Lino Lakes City Council <br />From: Marty Asleson <br />Re: Ordinance No. 03 -02, An Ordinance Regulating The Surface Use of <br />Motorized Watercraft on Peltier Lake, Request to Remove Sunset Clause from <br />Section 8 of Ordinance 03 -02. <br />Ordinance 03 -02 (Attachment 1), Adopting Surface Water Zoning Requirements For <br />Peltier Lake, contains a "Sunset Clause" in section 8 of the ordinance. Section 8 states <br />the ordinance shall be repealed automatically on September 1, 2004. <br />Since the implementation of the No -Wake Zone, it has been found that there has been a <br />positive effect on the nesting habits of the Great blue herons on Peltier Lake <br />(Attachments 2,3). Included with this memo is a letter from County Commissioner <br />Rhonda Sivarajah (Attachment 4), an interest story in a recent Minnesota Volunteer <br />Magazine, and information from the Peltier Lake Association President Mr. Wayne <br />LeBlanc (Attachment 6). <br />The purpose of this report is to inform the Council that it is the desire of staff and the <br />Heron Task Force to Amend Ordinance 03 -02, Section 8 to exclude the Sunset Clause. <br />The following schedule would be followed to achieve this amendment: <br />May 10th, Council meeting, 6:30 PM 1st reading of the Ordinance <br />May 24, 2nd Reading of the ordinance <br />30 day waiting period, ordinance is enforced. <br />Attachments: The following attachments are included with this memo: <br />
