Memorandum
DATE: June 7, 2004
TO: Mayor and City Council Members
FROM: James E. Studenski, City Engineer
RE: Marilyn Drive /Country Lane Utilities Petition
The City has received a petition from residents and property owners on Country
Lane and Marilyn Drive for sanitary sewer and water service. The petition
consisted of 5 parcels on the two streets. City Council directed staff to send a
letter to the residents in the area to find out if there is more interest in extending
city utilities. It has been a month since the letter has been sent out and we have
received a response from a total of 14 of the 54 residents (map attached). All of
them were in favor of moving forward in the process.
Currently the City Attorney has sent a letter dated June 1, 2004 to four residents
in this area regarding non - compliance with replacing a fail septic system within
24 months of notification. This letter gives them ten days to bring their system
into compliance (copy attached).
The area of the petition is defined as Low Density Unsewered Residential. It is
outside of the Stage 1 and 2 Growth Areas. Country Lane is outside of the
MUSA boundary.
City Staff is requesting further direction from the City Council on how to
proceed with this petition to extend city utilities.
