City Council <br />Legacy at Woods Edge Plans & Specs <br />October 25, 2004 <br />CITY OF LINO LAKES <br />RESOLUTION NO. 04 -164 <br />RESOLUTION AUTHORIZING PREPARATION OF PLANS AND SPECIFICATIONS <br />LEGACY AT WOODS EDGE <br />WHEREAS, Resolution No. 04 -83 adopted by the council on June 14, 2004, fixed a <br />date for a council hearing with reference to the Legacy at Woods Edge project, on <br />proposed improvements of street, sanitary sewer, water main, storm sewer, <br />streetscaping and sidewalks within the development area and to make street and storm <br />sewer and Traffic Signal improvements to Lake Drive adjacent to the site; and <br />WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was <br />given, and the hearing was held thereon on the 12th day of July, 2004, at which time all <br />persons desiring to be heard were given an opportunity to be heard thereon, and <br />WHEREAS, in accordance with City Charter provisions 60 days must elapsed after the <br />public hearing before the council can take further action on the proposed improvement, <br />and <br />WHEREAS, said 60 days have elapsed since the date of the public hearing and a <br />petition against said improvements has not been filed with the City; and <br />WHEREAS, the City Council finds that preparation of plans and specifications will <br />provide helpful information in determining the desirability and feasibility of the proposed <br />improvements. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. Short, Elliott, Hendrickson, Inc., is hereby designated as the engineer for this <br />improvement. The engineer shall prepare plans and specifications for the making of <br />such improvement. <br />Adopted by the Lino Lakes City Council this 25th day of October 2004. <br />• Ann Blair, City Clerk <br />John J.
