City Council Legacy at Woods Edge Plans & Specs October 25, 2004 CITY OF LINO LAKES RESOLUTION NO. 04 -164 RESOLUTION AUTHORIZING PREPARATION OF PLANS AND SPECIFICATIONS LEGACY AT WOODS EDGE WHEREAS, Resolution No. 04 -83 adopted by the council on June 14, 2004, fixed a date for a council hearing with reference to the Legacy at Woods Edge project, on proposed improvements of street, sanitary sewer, water main, storm sewer, streetscaping and sidewalks within the development area and to make street and storm sewer and Traffic Signal improvements to Lake Drive adjacent to the site; and WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held thereon on the 12th day of July, 2004, at which time all persons desiring to be heard were given an opportunity to be heard thereon, and WHEREAS, in accordance with City Charter provisions 60 days must elapsed after the public hearing before the council can take further action on the proposed improvement, and WHEREAS, said 60 days have elapsed since the date of the public hearing and a petition against said improvements has not been filed with the City; and WHEREAS, the City Council finds that preparation of plans and specifications will provide helpful information in determining the desirability and feasibility of the proposed improvements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. Short, Elliott, Hendrickson, Inc., is hereby designated as the engineer for this improvement. The engineer shall prepare plans and specifications for the making of such improvement. Adopted by the Lino Lakes City Council this 25th day of October 2004. • Ann Blair, City Clerk John J.
