Lino Lakes residents or businesses, or if the defect will result in unmonitored use of Lino Lakes <br />water. In the event of an emergency, repair procedures shall be undertaken as soon as reasonably <br />possible, but nothing herein shall prevent Lino Lakes from taking appropriate steps to protect the <br />security of the Lino Lakes water system and the health, safety and welfare of the Lino Lakes <br />residents. All repair and maintenance shall be completed within a reasonable time. <br />ARTICLE III <br />Miscellaneous Provisions <br />A. All general and special conditions, plans, special provisions, proposals, <br />specifications and contract for the water system shall and hereby are made a part of this Agreement <br />by reference as if fully set our herein in full. <br />B. This agreement may be terminated by Lino Lakes in the event that: <br />1. Blaine violates the terms of this Agreement, the provisions of Lino <br />Lakes City Code relating to the Lino Lakes water system, or <br />amendments thereto; and such violation continues for thirty (30) days <br />after Blaine receives a written notice of violation from Lino Lakes. <br />2. Blaine fails to properly maintain its water system after reasonable <br />notification and opportunity to cure. <br />C. This agreement may be terminated by Blaine in the event that: <br />1. Lino Lakes violates the terms of this Agreement, the provisions of <br />Blaine City Code relating to the Blaine water system, or amendments <br />thereto; and such violation continues for thirty (30) days after Lino <br />Lakes receives a written notice of violation from Blaine. <br />2. Lino Lakes fails to properly maintain its water system after reasonable <br />notification and opportunity to cure. <br />D. This Agreement shall be placed of record so as to give notice hereof to <br />subsequent purchasers, the cost of said recording shall be borne by Lino Lakes. <br />5 <br />
