3 <br /> <br /> <br />d. Adequate infrastructure must be available to support development. Appropriate analysis <br />will determine if adequate infrastructure is available and what utility extensions and <br />transportation improvements are required to support new development. <br /> <br />The “Development” is located in Sanitary Sewer District 3 (Sub-district 3C) and is <br />served by a MCES Interceptor 76-51, a 24-inch gravity sewer in Cedar Street which is <br />adequate to support the development. <br /> <br />e. There must be a commitment that the development will pay its proportionate share of <br />infrastructure improvement costs associated with development. <br /> <br />The Developer shall enter into a Development Agreement with the City committing to pay <br />its proportionate share of the infrastructure improvements; and <br /> <br />WHEREAS, the Utility Phase 1A boundaries are generally consistent with the “Development” <br />Phasing Plan Phase I and II boundaries and the Utility Phase 1B boundaries are generally <br />consistent with the Phasing Plan Phase III and IV boundaries; and <br /> <br />WHEREAS, the “Development” is found to meet the criteria to allow development to occur <br />early in a five-year phase; and <br /> <br />WHEREAS, a land use application for PUD Final Plan/Final Plat, a Development Contract <br />detailing escrows and a summary table by lot and block of lot sizes and setbacks shall be <br />required. <br /> <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />hereby approves the PUD Development Stage Plan/Preliminary Plat for NorthPointe, subject to <br />the following conditions being met prior to approval of the PUD Final Plan/Final Plat: <br /> <br />1. All comments from City Engineer letter dated February 7, 2014 shall be addressed. <br />2. All comments from Anoka County Highway Department dated January 24, 2014 shall be <br />addressed. <br />3. All comments from MNDOT letter dated December 5, 2013 shall be addressed. <br />4. All comments from Environmental Coordinator letter dated February 3, 2014 shall be <br />addressed. <br />5. Approval or Conditional Approval Pending Receipt of Changes (CAPROC) from Rice <br />Creek Watershed District shall be required. <br />6. A summary table created in Microsoft Excel by lot and block of lot sizes (gross, <br />unbuildable and net area) and setbacks (front, rear and side) shall be required. <br />7. The Phasing Plan for development shall be incorporated into the plan set and listed on the <br />Sheet Index. <br />8. The Phasing Plan identifies 215 lots, however; the preliminary plat indicates 216 lots. <br />The Phasing Plan shall be revised. <br />9. The Floodplain Exhibit shall be incorporated into the plan set and listed on the Sheet <br />Index. <br />10. A Letter of Map Revision (LOMR) shall be obtained from the Federal Emergency <br />Management Agency (FEMA) prior to issuance of any building permits for parcels <br />located within the floodplain.
