• Royal Oaks Realty CUP — Materials Storage <br />Page 5 of 7 <br />The Royal Oaks Realty — Material Storage Conditional Use Permit was presented at the <br />April 1 1th and May 9th Planning and Zoning Board meeting and was denied by a vote of 4-3 on <br />May 9, 2007. <br />May 9, 2007 Planning and Zoning Board Comments: <br />Board members gave the following rational for denying a CUP that was recommended for <br />approval by staff: <br />Traffic volume is to intense for surrounding area. <br />Nuisance to residents and the surrounding area. <br />City Ordinance does not apply to an ongoing process. <br />Monitoring traffic on site use will be difficult. <br />An end date is not specified in conformance with the City Ordinance <br />Functions as a business that is not allowed in a rural zone. <br />Recommendations: <br />Conditions met by the applicant since the April 11, 2007 Planning and Zoning Board Meeting <br />1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance with <br />Minnesota Pollution Control Agency (MPCA) requirements has been <br />prepared by the applicant. <br />2. The house foundation has been properly removed from the site. <br />3. The existing septic system has been abandoned according to City <br />requirements. <br />4. The site has been cleared of debris and other objects to provide a safe <br />situation for the proposed material hauling operation. <br />5. The site has fence and barricaded entrances to prevent the general public <br />from depositing garbage or refuse. <br />Staff recommends approval of the conditional use permit subject to the following conditions of <br />which some have been adjusted in response to the April 11 and May 9th planning and zoning <br />meetings: <br />1. Maximum slope on the pile shall be a 1 to 1 and in such condition as not <br />to be dangerous because of sliding or caving banks. <br />2. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or <br />other like and similar non - decomposable material. Concrete, asphalt, <br />metal, wood, and other debris shall be prohibited. <br />-80- <br />
