This modification to the Agreement is being required by Brad <br />Wozney of the Minnesota Board of Water and Soil Resources (BWSR) who you and I met with <br />along with a representative of the attorney general's office. Their objection to the current Joint <br />Powers Agreement funding provision is that it allows any individual member to disapprove the <br />operating budget and capital improvement budget allocations and thus, in their words, "each <br />member has veto power on budgets and projects ". <br />The modifications to the Joint Powers Agreement, contained in the amended language of Article <br />VIII, a marked up and a clean copy of which I enclose herewith, provide for the following: <br />1. Members are given the opportunity to review and make recommendations to the <br />VLAWMO Board regarding the proposed operating and capital improvement <br />budgets for the following calendar year. <br />2. The VLAWMO Board makes a final determination on the operating and capital <br />improvement budgets and the allocation of the costs among members. <br />2 <br />I 2OCT? <br />
