If a member objects to its allocation, the decision of the Board may be appealed to <br />final and binding arbitration before a three party arbitration panel, one appointed <br />by the appealing member, anothbr appointed by the VLAWMO Board and a <br />neutral third -party arbitrator, who will act as chair, appointed by the Chief <br />Administrative Law Judge of the State or the Chief Judge of the Ramsey County <br />District Court. The decision of the arbitration panel will be final and binding and <br />will be enforceable in the District Court pursuant to Minnesota Statutes, Chapter <br />572, the Uniform Arbitration Act. <br />This procedure is similar to the procedure set forth in the Joint Powers Agreement establishing <br />the Shingle Creek Water Management Commission which includes the Cities of Brooklyn <br />Center, Brooklyn Park, Crystal, Maple Grove, Minneapolis, New Hope, Osseo, Plymouth and <br />Robbinsdale. <br />With the above - described modification to the Join Powers Agreement, the BWSR representative <br />has indicated that BWSR will approve the Agreement. <br />Call me if you have any questions or suggested modifications. <br />Very truly yours, <br />JENSEN, BELL, CONVERSE & ERICKSON <br />Roger A.
