• <br />• <br />AGENDA ITEM 6.A. <br />STAFF ORIGINATOR: Paul Bengtson <br />CC MEETING DATE: November 26, 2007 <br />TOPIC: Continued Public Hearing <br />1st Reading of Ordinance 17 -07 <br />Vacating a portion of the drainage and utility easement on <br />Lot 16 Block 4 of the recorded plat Park Grove <br />VOTE REQUIRED: 4/5 <br />BACKGROUND <br />Stephen & Jacklyn Tlachac have requested that the City Council vacate a portion of the drainage <br />and utility easement on Lot 16 Block 4 of the recorded plat Park Grove. They are requesting that <br />the 30 foot easement along the south property line be reduced to 15 feet in width to allow <br />improvements including a swimming pool and deck. <br />This item was on the November 13, 2007 City Council Agenda, and after the public hearing was <br />opened and comments were taken, the City Council voted to continue the public hearing and <br />table the item to the November 26, 2007 meeting. <br />The applicant also discussed the proposal with the surrounding neighbors on November 16th and <br />17th to try and clarify his proposal and inform the neighbors of his plans. <br />ANALYSIS, <br />The easements as platted on the Park Grove plat included a thirty foot wide easement on the <br />south property line of this lot. Staff has found no historical information as to why the easement <br />within this area was platted at 60 feet of total width. The existing improvements can easily be <br />maintained by the city if within a 30 foot wide easement area, hence staffs original <br />recommendation that the vacation be approved. <br />The surrounding neighbors have brought a larger drainage issue to the city's attention as a result <br />of this application. Attached is a drawing indicating the drainage improvements and patterns in <br />the area, as was requested by the City Council. Staff will now meet with residents in the area to <br />get a better understanding of the actual drainage issues they are experiencing and work to <br />determine a solution. <br />RECOMMENDATION <br />Staff recommends continuing the public hearing and tabling the item. <br />• ATTACHMENTS <br />1.
