Council Member moved for adoption of the following ordinance: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 17 -07 <br />AN ORDINANCE VACATING A PORTION OF '1'l LL DRAINAGE AND UTILITY <br />EASEMENT ON LOT 16 BLOCK 4 OF 'ME RECORDED PLAT PARK GROVE. <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1 Findings <br />The City Council makes the following findings regarding the application to vacate a permanent roadway <br />easement: <br />1. Stephen & Jacklyn Tlachac have requested that the City Council vacate a portion of the drainage and <br />utility easement on Lot 16 Block 4 of the recorded plat Park Grove. <br />2. A public hearing was held on November 13, 2007 before the City Council in the city hall on such <br />request after due published and posted notice had been given, as well as personal notice to affected <br />property owners by the clerk on October 25, 2007 and all persons interested were given an <br />opportunity to be heard; <br />3. It appears that it will be in the best interest of the city to approve such request <br />Section 2 <br />Such request is hereby granted and that drainage and utility easement described as follows are hereby <br />vacated: <br />The north 15 feet of the south 30 feet of Lot 16, Block 4, PARK GROVE, Anoka County, <br />Minnesota, except the east and west 5 feet of said Lot 16. <br />Section 3 <br />That any person, corporation or city owning or controlling easements contained upon the property vacated <br />reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated <br />to maintain, repair, replace, remove or otherwise attend thereto. <br />Section 4 <br />This ordinance shall be in force and effect upon its adoption and publication and in accordance with the <br />Lino Lakes City Charter. <br />John Bergeson, Mayor <br />Attest: Julianne Bartell, City Clerk <br />Adopted by the Lino Lakes City Council this `' day of , 2007. <br />The motion for the adoption of the foregoing ordinance was duly seconded by Council Member <br />and upon a vote being taken thereon, the following voted in favor thereof: <br />The following voted against same: <br />Whereupon said ordinance was declared duly passed and adopted. <br />—40— <br />
