Motion carried on a voice vote; Council Member Rafferty <br />92 absent. <br />93 <br />94 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCIIIA <br />95 <br />96 There was no report from the Public Safety Department. <br />97 <br />98 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />99 <br />100 There was no report from the Public Services Department. <br />101 <br />102 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA <br />103 <br />104 6A) Resolution No. 10 -26 denying a variance request to the zoning requirements for <br />105 accessory structure area and the number of accessory structures allowed on a rural property <br />106 — City Planner Bengtson explained that the applicant, Ms. Sandy Nordstrom, has requested a <br />107 variance to allow her to build an additional accessory structure (horse training facility) on her rural <br />108 property at 1288 Main Street. Since the property does not quality for an additional structure, the <br />109 applicant is asking consideration of the fact that the property includes a parcel of 17 acres of land <br />110 that is leased. Staff and the Planning and Zoning Board are recommending denial of the variance <br />111 request based on the findings included in the staff report. <br />112 The council noted that there was considerable discussion at the work session preceding this meeting <br />113 about this matter. While there is great interest in supporting an area busienss, there is concern about <br />114 setting a bad precedent if the variance were allowed. <br />115 Sandy Nordstrom, 1288 Main Street, addressed the council. She explained that she is in the <br />116 business of training horses and she would like the ability to cover the area she currently uses as a <br />117 training track so that it can be used year around. The business has become her sole occupation so <br />118 she needs to be able to operate as much as possible. The structure is portable and she'd be willing <br />119 to take it down if necessary. <br />120 The council explained to Ms. Nordstrom that they agonized over the question of denying this <br />121 variance. While they'd very much like to find a way to allow the structure, it would be very unwise <br />122 to set a precedent on the question of considering leased land.. <br />123 Council Member O'Donnell moved that the item be postponed to the meeting of April 12, 2010, <br />124 and that staff be directed to look for a different approach that would allow the requested structure <br />125 (without a variance). Council Member Roeser seconded the motion. Motion carried on a voice <br />126 vote; Council Member Rafferty absent. <br />127 6B) First Reading of Ordinance No. 05 -10 amending a Planned Unit Development by <br />128 amending the Town Center Design & Development Guide Regarding Outdoor Dining /Seating <br />129 — City Planner Smyser explained that staff is presenting a change to the specific design guidelines <br />130 for the Town Center area that would mirror recent changes to the zoning regulations relative to <br />131 outdoor diningiseating requirements. <br />3 <br />—1 0 0— <br />
