as <br />• <br />Section 1: Definitions <br />A. Contract: A legally binding agreement between City of Lino Lakes and a <br />contractor to provide goods or perform services. All contracts should be written. <br />B. Contractor: A contractor is any person or entity hired to perform work on a <br />contract basis. Contractors are not City of Lino Lakes employees, are not directly <br />supervised by City of Lino Lakes employees, and are paid according to terms of <br />the contract. Also referred to as an Independent Contractor. <br />C. On -call Contractor: A contractor who is used on an on -going basis for City of <br />Lino Lakes to perform work as needed. <br />D. Sub - contractor: Any entity or person hired by the contractor to complete parts of <br />the project. <br />Section 2: Program Requirements <br />A. <br />Contractor safety records <br />1. City of Lino Lakes will make efforts to hire c. ors with good safety <br />records. Bid specifications for contract work wi' when possible, include <br />a requirement that th WAtractor have a workers' compensation modifier <br />of 1.1 or lower. Prior to beginning work, the contractor must provide City of Lino Lakes <br />with the appropriate certificates of insurance. <br />C. Indemnification <br />1. Transfer risk to the contractor. <br />?. The contractor should agree to defend and indemnify City of Lino Lakes for <br />any claim against City of Lino Lakes or City of Lino Lakes employees, <br />officers or agents arising from the contractor's acts or omissions. <br />Recommendations and comments are provided for loss control and risk exposure improvement purposes only in <br />conjunction with the insurance program referenced above.
