as • Section 1: Definitions A. Contract: A legally binding agreement between City of Lino Lakes and a contractor to provide goods or perform services. All contracts should be written. B. Contractor: A contractor is any person or entity hired to perform work on a contract basis. Contractors are not City of Lino Lakes employees, are not directly supervised by City of Lino Lakes employees, and are paid according to terms of the contract. Also referred to as an Independent Contractor. C. On -call Contractor: A contractor who is used on an on -going basis for City of Lino Lakes to perform work as needed. D. Sub - contractor: Any entity or person hired by the contractor to complete parts of the project. Section 2: Program Requirements A. Contractor safety records 1. City of Lino Lakes will make efforts to hire c. ors with good safety records. Bid specifications for contract work wi' when possible, include a requirement that th WAtractor have a workers' compensation modifier of 1.1 or lower. B• Insurance requirements When a new contract is awarded, the contractor must name the city on all relevant policies as an "Additional Insured ". contractors must provide updated coverage information annually as wet as when their coverage changes and when their policies are wed. • 3. Prior to beginning work, the contractor must provide City of Lino Lakes with the appropriate certificates of insurance. C. Indemnification 1. Transfer risk to the contractor. ?. The contractor should agree to defend and indemnify City of Lino Lakes for any claim against City of Lino Lakes or City of Lino Lakes employees, officers or agents arising from the contractor's acts or omissions. Recommendations and comments are provided for loss control and risk exposure improvement purposes only in conjunction with the insurance program referenced above. What `insurance program' is referenced above? They are not made for the purpose of complying with the requirements of any 'taw, rule or regulation. We do not infer or imply in the making of the recommendations and comments that all sites ware reviewed or that all possible hazards were noted.
