• <br />• <br />• <br />Requested Council Direction <br />The City's ordinance and its actual practice need to be consistent with each other and <br />with state law. The City Attorney is therefore recommending that the following issues be <br />addressed by the Council: <br />o Does the City wish to conduct a background investigations for liquor license <br />renewals? <br />o If so, would it be on all renewals as a matter of policy or only with respect <br />to particular applications? <br />• If on all renewals (as is the current practice), then a resolution to <br />that effect that explains the rationale for the renewal investigations <br />should be approved by the Council and the liquor ordinance should <br />be amended to remove the "particular application" language. <br />• If on only particular renewal applications, then a resolution is not <br />needed and the ordinance can remain as is, but staff should be <br />directed to stop doing renewal investigations as a matter of course <br />and to draft a procedure for determining when to ask the Council <br />for permission to conduct an investigation. <br />o If renewal investigations are not desired, then no action is necessary other <br />than to direct staff to stop conducting the investigations unless otherwise <br />directed by the Council. <br />o If the City will undertake renewal investigations, will the investigation fee remain <br />the same as it is currently? No distinction between the initial and renewal fees? <br />2 <br />
