CONTINUED PUBLIC HEARING for a P reliminary Plat for an eight lot <br />residential subdivision to be called Grandview, 7330 Lake Drive, Royal Oaks Realty <br /> <br />Mr. Bengtson presented the staff report. St aff recommended approva l of the Preliminary <br />Plat subject to eight conditions as listed in the staff report. <br /> <br />Mr. Larry Leibel Sr., 1281 Birch Street, stated that he has been a resident of Lino Lakes <br />for 56 years and a member of the church sinc e he was born. Mr. Leib el stated that the <br />church would like to sell the property in or der to pay down their loan, possibly acquire <br />city utilities, offer additional services to the community, encourage new church <br />membership and allow for future success of the church. <br /> <br />Mr. Mike Black, Royal Oaks Realty, Applican t, stated that he understands and accepts <br />the conditions of approval. <br /> <br />Mr. Hyden made a MOTION to close the P ublic Hearing at 6:44 p.m. Motion was <br />supported by Mr. Pogalz. Motion carried 4-0. <br /> <br />Mr. Pogalz made a MOTION to recommend approval of the Preliminary Plat for <br />Grandview, 7330 Lake Drive, subjec t to the following conditions: <br /> <br />1. All lots in the plat must agree to connect to City utilities. The City will not approve <br />the final plat without legally enforceable assurance that all properties will connect. <br /> <br />2. Issues discussed in the C ity Engineer review memo must be addressed to his <br />satisfaction. <br /> <br />3. A development agreement between the city and the developer must be executed prior <br />to the issuance of any building permits for the site. <br /> <br />4. Park dedication must be paid in acco rdance with the city’s fee schedule. <br /> <br />5. A conservation easement shall be granted over the drainage and utility easement <br />within the lots fronting Marsha n Lake. Easement restrictions shall be defined prior to <br />city council approval of the final plat. <br /> <br />6. The Rice Creek Watershed District must revi ew the project prior to building permits <br />being issued by the city for any new construction. <br /> <br />7. A boulevard tree shall be provided for each lot frontage. <br /> <br />8. The existing roadway easement shall be vacated by the City Council prior to the <br />approval of the final plat. <br /> <br />Motion was supported by Mr. Root. Motion carried 4 - 0. <br />
