Planning&ZoningBoard <br />November8,2006 <br />Page 2 <br />APPROVED MINUTES <br />A.PUB LICHEARINGfora PreliminaryPlatandVariancesforfrontsetbackand <br />uplandlotareaforFran’sEstate <br />Mr.Bengtsonpresentedthestaffreport. <br />Mr.Bengtson stated thatthisitemwasdiscussedattheOctober11,2006 meeting .Mr. <br />Bengtson notedacorrectiontothestaffreport thatparkdedicationforthisapplication <br />wouldincludeonelotonly,andtheamountwouldbeadjusted fromthestaffreport .He <br />clarifiedthat the conditionreferringtoparkdedicationdidnot specify anamount, <br />t h ereforenocorrectiontotheproposedcondi tionwasnecessaryforthiscorrection . <br />Mr.Nelson asked staff about limitingthetypeofconstruction inthiscase .Mr.Bengtson <br />s aid that the applicant couldreducethesizeofthe buildingpadsforeachhouse inorder <br />to increasethesetbackamounts.Mr.Bengtson pointedoutthat anyhomebuiltwould <br />needtomeet a 40 -footsetback ,soadjustingthebuildingpad couldbe apossibility. <br />Mr.Laden notedthatth ehousetothewest had asidey ardsetbackof28 feet ,andasked <br />staffifthereis adifferencebetween meeting side or front yard setbacks.Staffreplied <br />thatu ndercurrent city ordinance,thefullsetback amount isrequired forboth .Staff <br />notedthat t heordinance mayhavebeen differentatthetime thehousenextdoor was <br />constructed . <br />Mr.Bengtsonstatedthatthezoningordinanceallowancetoreducefrontsetbackstothe <br />averagesetbackofadjoiningpropertiesdoesnotapplytothissitebecausethepropertyto <br />thewestdoesnotfrontontoBirch Street.However,ifitdidapply,theaveragesetbackof <br />theadjoiningpropertieswouldbe20.5feet.Thisaverageisfromtheexistingrightof <br />waylines.Iffullrightofwaywasgranted,thehousetotheeastwouldhaveasetbackof <br />closetozero. <br />A pplicant,FranTourville,6948LakeDr,LinoLakes ,saidthathispropertywastheonly <br />landonB irch Street thatha d a10footeasementtakenfromit.Henotedthatthis puts his <br />setback amount anothertenfeet.Mr.Tourville statedthathe wasn’taware ofthesizeof <br />the revised buildingpadsuntilhegottheagenda ,ashehadnotbeenoutofcontactwith <br />hisengineer .Mr.Tourville saidhe feltthatthe buildingpadscouldbereduced even <br />further than currently proposed .Mr.Tourville statedthatthe wetlandwasdelineatedas <br />Class3,andthathecouldgetapermit toremove400sq.ft.whichhecouldapplytolot <br />two . <br />BoardMembersdiscussedpossibleoptionswiththeapplicant. <br />M r.Tourville saidthathe wastoldhecouldget a permit tofill 400s q.ft.withoutany <br />mitigation exchange. <br />CityEngineer Jim Studenskistatedthatthereisanamount thatcanbeimpactedwithout <br />mitigation. <br />Mr.Tourvillestatedthathe could attemptto increase the front setback s for both lots.
