• <br />• <br />Third Draft <br />March 3, 2006 <br />YMCA/CITY OF LINO LAKES <br />AMENDED AND RESTATED DEVELOPMENT AGREEMENT <br />THIS AGREEMENT, made as of the day of <br />between the CITY OF LINO LAKES (the "City") y , 2006, by and <br />PAUL ( "YMCA ") ( Y ") and the YMCA OF GREATER R SAINT <br />This Agreement supersedes the Development Agreement, dated June 16, 2005, by <br />and between the City and the YMCA. <br />A. FACILITY <br />1. The YMCA will construct a facility on the property described in Exhibit A (the <br />"Site ") of approximately 45,000 square feet that includes a teen center, gym, indoor <br />lap swimming pool, leisure style zero -depth pool, cardiovascular /strength training <br />area, aerobic studio, family program space, women's, men's and family locker rooms, <br />and Kids Stuff childcare (the "Facility "). Building design will provide for future <br />expansion opportunities. <br />2. The YMCA site and building plan will adhere to the principles of the planned unit <br />development ( "PUD ") approved for the Site, and the Lino Lakes Town Center Design <br />and Development Guide referenced in the PUD, unless amendments to the PUD are <br />approved by the City in accordance with City ordinances and procedures. The parties <br />agree and understand that the transfer of land will be subject to City trail and <br />conservation easements and reciprocal parking easements at locations mutually <br />agreed by the parties, and that the site plan will include provisions for preservation of <br />existing trees on the Site. <br />
