• <br />No. <br />CFMS Contract <br />STATE OF MINNESOTA <br />JOINT POWERS AGREEMENT <br />FOR PROFESSIONAL /TECHNICAL SERVICES <br />State Project Number (S.P.): 0282 -25 Trunk Highway Number <br />(T.H.): I -35E <br />Project Identification: Preliminary Design for CSAH 14 at I -35E Interchange <br />This Agreement is between the State of Minnesota, acting through its Commissioner of <br />Transportation ( "State "), Anoka County, through its Board of Commissioners, <br />address: 1440 Bunker Lake Boulevard, Andover, MN 55304 ( "County "), and the City <br />of Lino Lakes, through its City Council, address: 600 Town Center Parkway, Lino <br />Lakes, MN 55014 ( "City "). <br />Recitals <br />0. Under Minn. Statutes § 15.061 State is empowered to engage such assistance as <br />deemed necessary. <br />0. Minnesota Statutes § 471.59 authorizes State, County and City to enter into this <br />• Agreement. <br />0. State is in need of preliminary design services for the interchange of I -35E at County <br />State Aid Highway (CSAH) 14 from approximately 2,000 feet west of the existing <br />interchange bridge to approximately 1,500 feet east of the existing interchange <br />bridge. <br />0. County will act as lead agency, will provide day -to -day project management for this <br />Agreement and will coordinate federal funding reimbursement for the overall project. <br />0. State, County and City have each committed funding toward the cost of services to <br />be provided in this Agreement. <br />0. County represents that it is duly qualified and agrees to perform all services <br />described in this Agreement to the satisfaction of State and City. <br />• <br />Agreement <br />1 Term of Agreement <br />1.1 Effective date: The date State obtains all required signatures under Minnesota <br />Statutes Section 16C.05, subdivision 2. <br />0.1 Expiration date: May 31, 2007, or until all obligations have been satisfactorily <br />fulfilled, whichever occurs first. <br />0.1 Survival of Terms: The following clauses survive the expiration or termination <br />of this Agreement: 6 — Liability; 7 — State Audits; 8 — Government Data <br />Practices; 9 — Intellectual Property; 10 — Venue. <br />0.1 Exhibits: Exhibits A and B are attached and incorporated into this Agreement. <br />
