Planning and Zoning Board: <br />On April 12, 2006 the board held a public hearing and ultimately recommended approval of this request subject <br />to five conditions. Since that time staff has amended condition number 3 to read six dogs as this was the intent <br />of the applicant's request, amended condition number 1 to include Section 607 of the City Code, and added a <br />condition (number 5 below) to eliminate the possibility of retail sales occurring on the site. <br />RECOMMENDATION <br />• <br />Staff recommends approval of Resolution 06 -73 approving a dog kennel at 7933 24th Avenue, subject to the <br />following conditions: <br />1. The applicant must obtain a dog kennel license from the City of Lino Lakes. <br />2. Ongoing compliance with Sections 502, 503, and 607 of the City Code. <br />3. At no time shall dogs that are not owned by the occupant of the dwelling be allowed to remain on the <br />property overnight. <br />4. A maximum of six dogs over the age of six months shall be kept on the property at any one time. <br />5. All animals kept on the property shall be licensed in accordance with city policies. <br />6. At no time shall the property be used for sale of animals or merchandising directly to customers. <br />7. Failure to comply with any of the conditions of this conditional use permit shall constitute grounds for <br />revocation of the license of such kennel. <br />8. If a license for a kennel is not obtained within one year after the date of the conditional use permit, the <br />permit is void. <br />9. If the dog kennel use ceases for more than one year the conditional use permit is void. <br />ATTACHMENTS <br />S1. Location Map <br />2.
